For heirs to receive money from the bank, register a home in their names or divide the estate, they need an order. Without a will, you apply for a succession order. With a will, you apply for a probate order.
I file the application, answer the Registrar's requests, and support the family until the order is issued and the estate divided.

Succession order or probate order
A succession order is issued when the deceased left no will, and the estate is divided under the Succession Law. A probate order is issued when there is a will, and the estate is divided according to it.
Who inherits without a will
Under the Succession Law, when the deceased left a spouse and children, the spouse receives the household movables, including the family car, and half of the rest of the estate. The children share the other half equally. In other families the division differs, so it is worth checking before filing.
How it works
- An application is filed with the Registrar of Inheritance, with the death certificate, the original will if there is one, and the heirs' details.
- The application is published, so that anyone who wishes to object can do so.
- If there is no objection and the documents are in order, the Registrar issues the order.
- If there is an objection, the case moves to the Family Court.
After the order
With the order, you turn to the banks, the Land Registry and other bodies. Where there are several heirs, it is worth agreeing in writing how the estate is divided, in an estate distribution agreement.
Objecting to a will
Anyone who believes a will was made under undue influence, without capacity or without the form the law requires can file an objection. See also four mistakes that turn a will into a dispute.
Questions
01How long does a succession order take?
Without objections and with complete documents, it is usually a matter of a few months, not years. Objections or missing documents lengthen it.
02Can I apply without a lawyer?
Yes, the application can be filed independently. A lawyer prevents mistakes in the documents and the heirs' details, and helps most where there is a will, assets abroad or a family dispute.
03What happens to the deceased's bank account?
The bank usually releases the funds to the heirs only once a succession or probate order is presented.
